Agreement

This website is operated by Caratory Private Limited. Throughout the site, "Caratory", "we", "us" and "our" refer to Caratory Private Limited. By visiting caratory.in, creating an account, contacting us or purchasing a product, you agree to these Terms of Service and the policies linked in our footer. If you do not agree, please do not use the store.

Eligibility and store use

You must use the store lawfully and provide accurate, current and complete information. You are responsible for safeguarding your account credentials. You may not attempt unauthorised access, interfere with security, introduce malicious code, scrape the store unreasonably or use our content or services for unlawful, fraudulent or infringing purposes.

Products and product information

Caratory offers fine jewellery in gold and certified lab-grown diamonds. We aim to describe products accurately, but jewellery dimensions, weights, diamond characteristics, gold weight, colour and appearance may vary within reasonable manufacturing tolerances. Images may be enlarged to show detail, and screen settings can affect colour. Final product weight and specifications may differ slightly from estimates and will be reflected in the invoice or certificate where applicable.

Customisation and sizing

Personalised, engraved, resized and made-to-order products are produced to the details confirmed by the customer. You are responsible for reviewing spelling, measurements, metal colour, design approvals and size before confirmation. Changes requested after production begins may be unavailable, delayed or chargeable. Custom products have restricted return rights as explained in the Refund & Returns Policy.

Prices, taxes and payments

Prices, offers and availability may change before an order is accepted. The checkout shows the applicable product price, taxes, discounts and delivery charges. We may correct an obvious pricing or product error, request payment or identity verification, limit quantities, or cancel and refund an order where necessary, including for suspected fraud or unavailable stock. Payment is processed by Shopify and authorised payment providers under their own terms.

Orders and acceptance

An order confirmation acknowledges receipt of your order; it does not guarantee acceptance. The order is accepted when Caratory begins fulfilment or dispatches the product. We may contact you to verify the order, recipient, address, size, design or payment. If we cannot accept an order, we will cancel it and refund the eligible amount paid.

Delivery, returns, exchange and buyback

Delivery is governed by the Shipping Policy. Returns and cancellations are governed by the Refund & Returns Policy. The lifetime programme is governed by the Lifetime Exchange & Buyback Policy, including the valuation of eligible lab-grown diamonds at 80% of their prevailing assessed market value. These policies form part of these terms.

Certificates and care

A relevant product or laboratory certificate is supplied where stated on the product page or invoice. Certificates apply to the described product and should be kept safely. Normal wear, accidental damage, loss, improper storage, exposure to chemicals, unauthorised repair and failure to follow care instructions are not manufacturing defects.

Intellectual property

The store's designs, photographs, video, text, graphics, branding, software and layout belong to Caratory or its licensors. They may not be copied, reproduced, modified, distributed or commercially used without prior written permission, except where law expressly permits.

Third-party services and links

The store is hosted by Shopify and may use third-party payment, delivery, appointment, analytics, communication and technology services. We are not responsible for an independent third party's service, content or privacy practices. Your use of those services may be subject to additional terms.

Disclaimer and liability

We do not guarantee that the store will always be uninterrupted or error-free. To the fullest extent permitted by law, Caratory is not liable for indirect, incidental, special or consequential loss resulting from use of the store, a third-party service, or a delay outside our reasonable control. Nothing in these terms excludes a statutory consumer right or liability that cannot legally be excluded or limited.

Indemnity

You agree to be responsible for loss reasonably incurred by Caratory because of your unlawful use of the store, your infringement of another person's rights, or a material breach of these terms.

Changes, severability and waiver

We may update these terms by posting a revised version. If one provision is unenforceable, the remaining provisions continue to apply. A delay in enforcing a right is not a waiver of that right.

Governing law

These terms are governed by the laws of India. Subject to mandatory consumer protections, courts in Mumbai, Maharashtra have jurisdiction.
